This paper presents an overview of forum selection clauses in maritime contracts within the United States court system. Generally, American courts have not favored forum selection clauses, but over time the courts have demonstrated a favorable shift towards forum selection clause enforcement. Landmark maritime forum selection clause cases are discussed. Additionally, the paper presents a synopsis of cases where arbitration agreements acted as forum selection clauses. Finally, the paper presents an analysis of the Supreme Court's most recent opinion on the proper procedural mechanism for enforcing forum selection clauses in the case of Atlantic Marine Construction, and the lower courts' interpretation of that opinion.
