Description of representation and indication of product under EU design law: a critical review of the tangle created in case T-202/22, TA Towers v EUIPO
Henning Hartwig
What the paper says
Under European Union trademark law, the mandatory indication of the goods and services according to the Nice Classification is paramount for assessing the scope of protection of a mark (except for a mark with a reputation). Likewise, using a description of the mark may be relevant when determining the subject matter of the mark (where a description is required or recommended). Things are different, for very good reasons, under established EU design law and practice. Unfortunately, a recent decision of the EU’s General Court (T-202/22, TA Towers v EUIPO , ECLI:EU:T:2024:28) departs from these standards and opens Pandora’s box.
