Abstract

Consumers increasingly rely on digital platforms in their daily lives, raising concerns about whether firms present information in ways that enable informed consumer choices. Drawing on recent federal enforcement actions, this article examines three areas where consumer understanding may break down: manipulative design patterns, the ability to identify organic content, and pricing transparency. It also reviews the legal tools available to enforcers and highlights the increasing importance of internal platform data in identifying potential violations.
