Structural injunctions represent an essential jurisdictional tool for solving collective conflicts of significant social scope. This study therefore aims to analyze the legitimacy and limits of the control exercised over public policies by the Supreme Federal Court in Theme 698 of General Repercussion, considering Neil Komesar's contributions regarding the need to choose the institution most suited to solving the structural problem (deciding who decides). This research uses hypothetical-deductive reasoning, using primary (rulings and laws) and secondary (doctrinal understandings) nature data, allowing us to conclude on the relevance of four principles (principle of the decision of who decides, the principle of institutional relevance, the principle of significant social results and the principle of temporal limitation of the duration of structural processes) to prevent the interpretation of constitutional norms compromising the separation of powers and the effectiveness of public policies.
