What the paper says

The coming into force of the Competition Act 1998 in March 2000 transformed the role and nature of the Office of Fair Trading. This article reviews the first abuse of dominance cases – Napp Pharmaceuticals and Aberdeen Journals – and collusion cases, notably Toys and Games and Football Shirts . While OFT infringement decisions were largely upheld by the Competition Appeal Tribunal, some non-infringement decisions were not. The early years were characterized by complete independence from Ministers but intense judicial scrutiny from the Tribunal, which, in hindsight, was a blessing in disguise.
